Simplified Divorce
The simplified procedure is straightforward as the name suggests and can be used if there are no children under 16 involved. If financial matters have been agreed you can divorce on the grounds of:
One years separation with consent
Two years separation (consent not required)
If the grounds for divorce are either unreasonable behaviour or adultery, the simplified divorce cannot be used regardless of the age of your children. In this case you must use the ordinary procedure.

What's Required
- You or your spouse to have lived in Scotland and resident at that address for 6 weeks.
- Financial matters finalised (don’t worry if not, we can prepare a legally binding separation agreement for a fixed fee).
- Your marriage certificate
- An address for your spouse

What to Expect
When we confirm that you qualify for the simplified divorce we will write to your spouse to let them know that you are applying for a simplified divorce and give them 7 days to respond.
After the 7 days we will complete the application. If the application is based on 1 years separation, we will send it to you to sign then forward to your spouse for their consent.
All that is required of you is a short appointment to sign the application with a Solicitor. This can be done via video call so there is no need to travel.
We submit the application to the court and arrange for sheriff officers to serve the papers on your spouse.
Your divorce should be confirmed in around 6-8 weeks.
